Family Law/Child Custody

Family Law distinguishes itself from so many other areas of law because of its emotional involvement with loved ones and family.  Child Custody and Child Support are important issues that The Thompson Law Firm's caring team of Attorneys will fight for.  In Texas there are many things to consider when talking about Child Custody and Support and we can advise you on filing for primary custody, who pays child support?, and how joint custody called "joint managing conservatorship" still requires a primary custodian of a child who would be due child support.

Modification/Relocation

Regardless of how a divorce is ultimately settled, children's needs and parents’ circumstances often change over time. The legal standard for determining child related issues is simply "the best interest of the children." The court determines best interests on a case by case basis. The best interests of children at the time of divorce may not necessarily remain best for the children years after the divorce. What happens if a parent remarries and the new spouse obtains a job out of state? Parents that divorce when their children are infants will likely face different issues when their children are teenagers.

In a modification case, the court will have to determine if a change in circumstance of either the parents or the children is significant enough to warrant a change of the parenting plan in the prior Order. Often times the attorney handling a modification action will not be the attorney representing a client in a modification action. Our firm can assist you with modifying your prior order whether you are a prior client, or a new client that utilized a different attorney for your original child custody lawsuit.

Wills and Trusts

The most essential aspects of estate planning are wills and trusts. Through a properly executed will, you can ensure that your assets are distributed as you wish upon your death. A trust can provide income for future generations and may have tax benefits. Wills and trusts can also detail how you wish to provide for your loved ones after you are gone. We can help you deal with the creation of wills and trusts that reflect your goals and wishes. Contact a lawyer at The Thompson Law Firm to schedule an appointment to discuss your individual situation and concerns.

Probate

After the death of a loved one, the legal issues that remain can be overwhelming and confusing. Dealing with the estate of a deceased loved one can be a complicated process. There are many laws that apply and without having a full understanding of these laws, your rights may be compromised.

Probate is a process through which the validity of a deceased individual's last will and testament is determined. An estate without a will may also be dealt with in probate court. Through probate, the court-supervised transfer of the title to assets is completed, as well as the transfer of property from the decedent to the beneficiaries as stated in the will, or dictated by state statutes. To further explain the details and nuances of the probate process, an attorney at The Thompson Law Firm can take the time to help you understand the many aspects of probate and how it may affect you as a relative or beneficiary of the deceased individual. You do not have to navigate the probate process alone. Contact us.

Criminal Defense

Our firm appreciates the importance of defending the rights of the accused, and we use all available means to ensure that clients receive outstanding legal representation and access to justice. The consequences of a criminal conviction can be devastating. These charges must be vigorously defended. If the government is trying to convict you of a crime, we will make sure that your rights are protected and that you are treated fairly.

Our firm handles all types of criminal defense matters in Texas' state and federal criminal courts, including drug charges, white collar crimes, all types of violent and theft crimes, spousal abuse / domestic violence crimes, DUI / drunk driving cases for both in-state and out-of state residents who were charged in Texas, disorderly conduct, possession of a controlled substance and possession of marijuana, and juvenile court matters.

DUI/DWI - The stakes are high

Driving While Intoxicated (sometimes called DWI or DUI) is one of the most common charges the average person might face. Police officers are being pressed to enforce the DWI laws very strictly and it is very easy to be wrongly accused. At the same time, the penalties for DWI cases have become increasingly severe over the last few years. In addition to the embarrassment and damage to reputation, a person charged with a second DWI faces penalties including jail for up to a year and a $4000 fine. Deferred Adjudication is specifically disallowed in DWI cases. Further, if your license is suspended as a result of a DWI, it now costs you $1000 a year for three years to be able to drive. The laws regarding DWI cases are very complex and the prosecutors are experts in this field. You need a criminal defense lawyer that has the knowledge, experience, and aggressiveness to level the playing field and hold the state to its burden.
